THE NORMATIVE FOUNDATIONS OF SOCIAL RELATIONS WITH NON-MUSLIM MINORITIES IN THE LIGHT OF ISLAMIC FIQH AL-SIYAR AND THEIR CONTEMPORARY APPLICATIONS

This study presents a comprehensive examination of the foundational principles of social relations with non-Muslim minorities and their contemporary applications in the light of Islamic Fiqh al-Siyar. Fiqh al-Siyar provides a normative and jurisprudential framework that guides social life through the principles of justice, equality, good conduct, and coexistence, offering effective and practical guidelines for implementing the rights and duties of non-Muslim minorities. The study begins by elucidating the concept, scope, sources of legislation, and principles of derivation of Fiqh al-Siyar, providing an intellectual foundation for understanding the fundamental rights, legal status, and social participation of non-Muslim communities.The research further explores the commonalities and differences in the rights and responsibilities of non-Muslim minorities across various Islamic schools of thought and illustrates how different jurisprudential interpretations have operationalized these rights. Through historical examples, particularly during the Rashidun and Abbasid periods, the study demonstrates that the rights of non-Muslim citizens were not merely theoretical principles but were practically enforced. These practical applications included financial obligations (such as Jizya), educational freedom, religious practices, and cultural and social participation, all of which ensured social harmony, justice, and coexistence.
Moreover, the study highlights the relevance of Fiqh al-Siyar principles in contemporary states, modern human rights systems, and international legal frameworks. It shows that Islamic jurisprudence provides practical guidance for safeguarding the rights, equality, and participation of non-Muslim minorities, not only in historical contexts but also in today’s multi-religious and multicultural societies. The principles of contemporary human rights, such as life, freedom, equality, religious liberty, and legal protection, are fully compatible with the precepts of Fiqh al-Siyar and offer practical guidance for implementing non-Muslim citizens’ rights and responsibilities within modern national and international legal contexts.This study offers a comprehensive analysis of non-Muslim minorities’ rights and duties, social protection, justice and benevolence, religious and social freedom, education, economic and cultural participation, and the practical manifestations of these jurisprudential principles. The research establishes that Fiqh al-Siyar provides not only theoretical but also practical frameworks for protecting non-Muslim minorities, ensuring their fundamental rights, and maintaining social harmony.The importance of this study is especially significant in contemporary multi-religious and multicultural societies, where challenges, legal obstacles, and human rights issues concerning non-Muslim minorities persist. The study demonstrates that Fiqh al-Siyar provides a normative and practical guideline that aligns with modern human rights standards, international laws, and national citizenship principles. It bridges jurisprudence, law, history, and human rights scholarship, offering scholars, legal practitioners, social leaders, and policymakers practical and academic guidance regarding the protection, equality, and inclusion of non-Muslim minorities.
